These Terms of Service govern access to and use of the CyConex website and platform. By using our services, you agree to these terms.

1. About these terms
These Terms of Service ("Terms") apply to your use of the CyConex marketing website and, where applicable, the CyConex software platform and related services (together, the "Service").
If you enter a separate written agreement with us — such as an order form, enterprise agreement, or Data Processing Agreement — that agreement takes precedence over these Terms to the extent of any conflict.
2. The Service
CyConex is an agentic assurance platform that helps organisations ingest evidence, assess controls against frameworks such as NCSC CAF, and produce structured assurance outputs. The platform is currently offered in early access; features described on the website or within the platform may change as the product evolves and is commercialised.
We may update, suspend, or withdraw parts of the Service for maintenance, security, or product development reasons. We will aim to minimise disruption to paying customers in accordance with any applicable service agreement.
3. Accounts and access
Access to the platform requires an authorised account. You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account and for ensuring users within your organisation comply with these Terms.
We may suspend or terminate access where we reasonably believe there has been a breach of these Terms, a security risk, or unlawful use of the Service.
4. Customer content and evidence
Customers retain ownership of evidence, documents, and other content uploaded or connected to the platform ("Customer Content"). You grant CyConex a limited licence to host, process, and analyse Customer Content solely to provide the Service.
You are responsible for ensuring you have the rights and lawful basis to upload Customer Content, including any personal or confidential information contained in evidence materials.
5. Acceptable use
You must not use the Service to:
- Upload unlawful, infringing, or malicious content.
- Attempt to gain unauthorised access to the platform or other customer data.
- Interfere with the security, integrity, or availability of the Service.
- Reverse engineer or misuse the platform except where permitted by law.
- Use the Service in a way that violates applicable law or third-party rights.
6. AI-assisted features
CyConex includes AI-assisted capabilities to support evidence review and assessment preparation. AI outputs are provided to assist qualified users and do not replace human judgement, professional advice, or formal assurance conclusions. You are responsible for reviewing and validating outputs before relying on them.
7. Fees and trials
Pricing, billing, and trial terms are described on our pricing page or in a separate commercial agreement. Unless otherwise agreed in writing, fees are exclusive of VAT and other applicable taxes.
8. Intellectual property
CyConex and its licensors own all intellectual property rights in the platform, website, documentation, and underlying software. Except for the limited rights expressly granted, no rights are transferred to you.
9. Confidentiality and security
Each party will protect the other's confidential information using reasonable care. We implement security measures appropriate to the nature of the Service, as described on our Security & trust page.
10. Disclaimers
The Service is provided for professional assurance workflows. We do not guarantee that use of CyConex will result in any particular compliance outcome, certification, or regulatory approval. Except as expressly stated in a written agreement, the Service is provided "as is" and "as available" to the extent permitted by law.
11. Limitation of liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law. Subject to that, CyConex shall not be liable for indirect, consequential, or special loss, or for loss of profits, revenue, data, or business opportunity. Our total aggregate liability arising out of or relating to the Service shall not exceed the fees paid by you for the Service in the twelve months preceding the event giving rise to the claim, except where a separate written agreement states otherwise.
12. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory rights you may have under applicable law.
